The Legal Division, in its tasks and functions, may be a department, as in the offices of state ministries and entities not affiliated with those ministries. It may also be a section, as in companies and public bodies, or a division, as in governmental and non-governmental directorates.
The names of the Legal Division vary according to the administrative and organizational structures of governmental institutions. However, despite the differences in nomenclature, they remain with similar tasks, duties, and specific authorities.
Objectives of the Legal Division
To provide legal protection for the governmental institution and defend it in court when lawsuits are filed against it by others.
To represent the governmental institution before courts and judicial bodies in a manner that ensures the rights of the institution and its obligations.
To achieve justice among all members of the governmental institution.
Duties and Responsibilities of the Legal Division
To conduct investigative committees and legal (rights-based) work between the institution and its members.
To provide legal opinions and advice, and to respond to inquiries and legal consultations.
To represent the governmental institution before the competent courts and judicial authorities.
To prepare and study proposed regulations, instructions, and bylaws that the governmental institution wishes to develop and to provide legal comments on them.
To draft, organize, and approve contracts, commitments, and guarantees related to the institution’s work.
To follow up on the allocation and expropriation of properties and to undertake procedures for providing and preparing residential units and land for the institution’s members.
To provide legal consultations to the college departments.
To review state departments to complete the college’s work from a legal perspective.
To authenticate guarantees and educational commitments inside and outside Iraq.
